Introduction
These terms govern your use of the SipnStay website, app, and services (collectively, the “Service”). By placing an order or signing up as a host you agree to be bound by them.
What SipnStay is
SipnStay is a marketplace. We connect hosts who operate short-term rentals (Airbnb, Booking.com, direct) with their arriving guests so the guest can order drinks, breakfast, charcuterie and other welcome items to be ready at check-in.
Hosts source and prepare the items themselves. SipnStay does not purchase, store, or deliver goods. Our role is the technical and commercial platform that lets the host charge and the guest pay ahead of arrival.
Who can use it
- You must be at least 18 years old (the minimum age in France to buy alcohol)
- You must have the legal capacity to enter into a contract
- You agree the information you give us is accurate
If you are a guest
- You place an order before arrival, paying ahead via Stripe
- Your order is sent to your host, who prepares and stages it at the property
- Items that contain alcohol are subject to French age-verification on delivery
- By submitting an order you confirm you are at least 18
- You are responsible for the email address and arrival date you provide
If you are a host
- You commit to fulfilling orders accurately and on time, before the guest arrival date
- You guarantee that all items you offer comply with French food, alcohol, and consumer law
- You are responsible for sourcing, storage, hygiene, and physical delivery to the property
- You handle your own VAT and income tax obligations on your share of the revenue
- You will not promote items or behaviour that could harm a guest's health or safety
- You accept that SipnStay may suspend or terminate your account for repeated complaints, fraud, or material breaches
Cancellations and refunds
Most items on SipnStay are perishable (food, drink, flowers, prepared baskets) and therefore fall under the exemption in Article L.221-28 of the French Code de la consommation, which excludes the 14-day cooling-off period for goods that spoil or have a short shelf life.
We will, however, refund:
- Orders cancelled by the guest at least 24 hours before arrival
- Orders where the host fails to deliver as agreed
- Items that arrive damaged or are demonstrably not fit for purpose
Contact hello@sipnstay.fr within 48 hours of arrival with photos and your order ID.
Prohibited uses
- Listing goods you cannot legally sell in France
- Listing items that imply they have therapeutic properties they do not
- Directing guests to pay or transact outside the platform
- Reverse-engineering, scraping, or republishing platform data
- Any conduct that interferes with the operation of the Service
Intellectual property
The SipnStay name, logo, design system, code, and product photography are our intellectual property. You may not copy, modify, or distribute them without our written consent. Hosts retain ownership of any photos and descriptions they upload but grant us a non-exclusive licence to display them on the platform.
Liability
SipnStay provides a marketplace; we are not the supplier of the physical goods. We do not warrant that any product will meet your expectations, taste, or dietary requirements. Hosts are solely responsible for the safety, quality, and accuracy of what they prepare.
Our aggregate liability for any claim arising out of the Service is capped at the amount you paid for the order giving rise to the claim, or €100 — whichever is higher. Nothing in these terms excludes liability for fraud, gross negligence, or where the law does not permit such exclusion.
Termination
You can close your account at any time by writing to hello@sipnstay.fr. We can suspend or terminate your access if you breach these terms, upon reasonable notice except where the breach is serious or repeated.
Governing law
These terms are governed by French law. Disputes are subject to the exclusive jurisdiction of the French courts, without prejudice to the consumer-protection rules of your country of residence.
Consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Changes
We may update these terms occasionally. We will notify you of any material change by email at least 30 days before it takes effect. Continued use after the effective date constitutes acceptance.
